LB 552 - The Nebraska Construction Prompt Pay Act Passed on Final Reading February 5th

The bill now awaits the Governors signature to become law for all construction contracts entered into on or after October 1, 2010.  This has been a top priority bill for the Chapter for the past two sessions.  Over two years ago the Building Chapter, NECA, MCA-Omaha and the Heavy Highway Chapter, along with our legal counsel from Woods & Aitken LLP started working on the language for this bill.  After many drafts, reviewed by members from all the groups, we came to agreement on the language for the bill.  Sen. Tom White introduced the bill last session and it had first round debate late in January.

LB 882 is the Next Bill of Focus

This bill adds one provision to the Nebraska Construction Lien Act.  LB 822 will provide upstream contracting parties with notice of an actual lien filing.  Currently, our statutes do not require any notice to be sent.  Thus, unless a party is monitoring the County Register of Deeds office, they may have no idea that a contractor or subcontractor has filed a construction lien.

BIM Tech Course - Only 2 Spots Left

Legislative Forum - March 3rd

Plan to attend this year’s AGC, AIA, ACEC Joint Industry Council’s Legislative Forum and Luncheon. Governor Heineman will be one of the speakers at the morning session and all the State Senators are invited to the luncheon.  All the information will be out soon, but for now SAVE THE DATE!

Regional Member Meetings

Regional Member Meetings were held in the past 10 days and we beat the weather for all five meetings.  Thank you very much to Kory George, Brian Koerwitz, Craig Dirrim, Monica Freeman and Todd Weidemann, all members of the legal team at Woods & Aitken LLP for providing the superb programs at all five meetings.  A total of 125 members attended this round of Regional Meetings.

Mark Duren and Josh Weiss, Lutz and Company CPA, deserve a big round of “Thanks” also.  They also developed and presented a great program for Regional Member Meetings that were scheduled in November, December and the final one in late January.

 

Member Directory Update

Time is running out to provide updated membership information to the Chapter office.  On January 4th a mailing went out requesting each firm to update all company information and return to the AGC office.  This is the info that will be published in the printed Member Directory.  The Directory will be out in mid-March. Make sure that someone in your firm updates the information and returns the form to the Chapter office.  Please provide update now, NOT after the Directory is printed.  Remember, the printed directory is based on information received by February 15th.  The electronic version of the directory is updated on a continual basis and can be found in the Member Only section of the website.

2010 window stickers along with the new “members only” password for the website and a few other items will be going out to paid current members by the end of the month.
