A Successful End Result On Recent Industry Issue

In November the folks from Gene Lilly Surety Bonds brought an issue to the Building Chapter that involved onerous penalty clauses in the Joint Forces project contract being let on December 15th by the Nebraska Military Department.

GLSB provided Jean Petsch with a contract analysis prepared by Brian Koerwitz, Woods & Aitken LLP that clearly illustrated the potential adverse effects of the penalty clauses to the contractor and in some cases the owner.  On behalf of the membership, Jean was able to communicate with the owner and successfully modify the damage clauses to be more “industry standard” and less onerous.  Amendment #3 was issued on 12-7-09 to the project by the owner.

This effort was a well orchestrated, corroborated plan between Jean, Jim King, Bob Cirone, and Brian Koerwitz.   The Building Chapter wished to acknowledge the hard work and expertise of Gene Lilly Surety Bonds and Woods & Aitken LLP on this issue.

 

ConsensusDocs And AGC Documents

If you are a small volume user of the ConsensusDocs or the exclusive AGC Contract Documents or just need a random document from time to time, call the office.  The Chapter office subscribes to the MeterMode subscription of both sets and will be glad to sell you single documents from any of the series.  All documents are electronic versions.  Also, you can procure the “other” brand (AIA) individual documents from the office.  Call Jean or Linda. 

 

Building Chapter Board of Directors News

The Board met on December 10th for the last meeting of the year.  At this meeting the 2010-11 Strategic Plan and Plan of Work was approved.  Click here to view.  The plan includes a continuation of what “is working” and adds several new initiatives for the association.  The State Fair Construction Learning Center will continue, along with developing a cooperative advertising program for GC Member Firms, creating a building awards program and re-inventing an Associates “Council”.  

 

2010 AGC Board Of Directors Officers Elected

The following are the officers and Executive Committee:  President-Don Wrieth, Kiewit Building Group; Vice President-Linette Butler, BD Construction Inc; Treasurer-Dan Vokoun, Sampson Construction Inc; Past-President-Wes Oestreich, Cheever Construction Co.  Also, a big thank you to Joe Welch, Paulsen, Inc. who is retiring from the board at the end of the year after serving for many, many years!  He was 21 when he came on the board………

December issue will be out shortly before the holidays.  This issue will include reports from each of the AGC Student Chapters, along with the usual outstanding articles written by the Chapter’s top corporate sponsors.


The Last Member Event Before the Holidays Is December 17th

This breakfast meeting is being sponsored by the Diamond and Platinum Sponsors so there is no charge to attend.  However, the folks at Quarry Oaks are getting up early to prepare breakfast so I need to have a headcount by end of Tuesday, 12/15.  Click here for reply form.  The folks from Lutz & Company CPA have a great, informative program planned.

LEED-AP Test Prep Update

The Building Chapter has joined forces with the AGC of Colorado, AGC of New Hampshire and the Sustainable Investment Group to bring you a test prep course that will be delivered live and online via Webex.com.  The Colorado and New Hampshire Chapter members have been using this online course with great success for the past year.  This will be a great opportunity for preparing for the first tier LEED-Green Professional accreditation.  Click here for course registration/details and here for a course outline.  Course dates are January 6, 13, 20, and 27th.  Total cost is $250.00.  Please call Jean if you have questions.
